ADGM Courts offer an English-language, common law pathway for enforcing foreign arbitral awards against Abu Dhabi assets — mirroring the DIFC conduit mechanism for Dubai. The ADGM-ADJD Protocol (2018) enables ADGM Court orders to be executed against mainland Abu Dhabi assets, creating a seamless conduit for award creditors.

ADGM Courts jurisdiction over foreign arbitral awards

ADGM Courts have jurisdiction to recognise and enforce foreign arbitral awards under ADGM Arbitration Regulations 2015 (ADGM Arb Regs), s 43. The ADGM Arb Regs implement the UNCITRAL Model Law on International Commercial Arbitration (2006 version) — giving ADGM proceedings full Model Law compliance. Section 43 mirrors NYC Art V grounds for refusal: incapacity, invalid agreement, due process, excess of jurisdiction, tribunal composition, award not binding, non-arbitrability, and public policy.

ADGM Courts jurisdiction requires that the award debtor has assets in Abu Dhabi or that the ADGM has some nexus to the dispute (e.g., ADGM-seated arbitration, contract performed in ADGM). The conduit mechanism — analogous to the DIFC conduit — does not require the underlying dispute to have ADGM connections. An ADGM recognition order may be registered under the ADGM-ADJD Protocol for execution of Abu Dhabi onshore assets.

Step-by-step ADGM enforcement procedure

Step 1 — File recognition application: File in the ADGM Court of First Instance under s 43 Arb Regs. Required documents: (i) original award or certified copy; (ii) original arbitration agreement or certified copy; (iii) translations into English. ADGM is English-language — no Arabic translation required. ADGM court fee: 3% of the amount claimed, subject to minimum and maximum (check current ADGM fee schedule).

Step 2 — Service: ADGM Court Rules govern service. For respondents in mainland Abu Dhabi, service through ADGM Court bailiff or Abu Dhabi notary. Electronic service may be permitted on application.

Step 3 — Recognition order: ADGM CFI issues recognition order under s 43. Timeline: 4–8 weeks uncontested; 6–18 months contested. Grounds for refusal: s 43 Arb Regs (identical to NYC Art V). ADGM Courts apply international public policy standard — consistent with English court practice.

Step 4 — ADGM-ADJD Protocol registration: File the ADGM recognition order with the Abu Dhabi Judicial Department (ADJD) under the ADGM-ADJD Protocol (2018) for ratification as an Abu Dhabi court order. This step enables execution against mainland Abu Dhabi assets.

Step 5 — Abu Dhabi execution: File execution application with Abu Dhabi Execution Court. Attach to Abu Dhabi bank accounts, real estate, vehicles, and other assets. Timeline from ADJD registration to execution: 2–6 weeks.

ADGM vs DIFC conduit — choosing the right pathway

Both conduits provide English-language recognition of foreign arbitral awards for UAE asset enforcement. The choice depends on where the assets are: DIFC conduit targets Dubai (onshore) assets via Dubai Courts; ADGM conduit targets Abu Dhabi (onshore) assets via ADJD. For award debtors with assets in both emirates, run both conduits simultaneously — there is no prohibition on parallel proceedings.

If the award debtor has assets in DIFC (DIFC financial accounts, DIFC-registered companies), enforcement directly in DIFC as a "domestic" DIFC matter may be more efficient. If the debtor has ADGM-registered assets (ADGM companies, ADGM financial accounts), ADGM enforcement is direct — no conduit required.

Practical checklist

  • Identify Abu Dhabi vs Dubai asset location — run both ADGM and DIFC conduits in parallel if assets are in both emirates
  • English-language documents: ADGM requires English translations — commission early to avoid delay
  • ADGM-ADJD Protocol: file ADJD registration promptly after ADGM recognition order — do not leave gap for asset transfer
  • Check ADGM fee schedule before filing: ad valorem court fee applies — verify current maximum cap
  • Freezing orders: ADGM Courts can grant freezing injunctions — apply simultaneously with recognition application
  • Contested proceedings: prepare to respond to s 43 grounds on ADGM public policy — ADGM applies a narrow international standard

What we'd typically advise

ADGM Courts have developed a strong reputation for commercial sophistication and consistent application of international arbitration standards. For enforcement of foreign awards against Abu Dhabi assets, ADGM Courts are often preferred over onshore Abu Dhabi court enforcement — the English-language proceedings are faster, the public policy standard is narrower, and the recognition process is more predictable. The ADGM-ADJD Protocol makes the onshore execution step seamless.

Frequently asked questions

Can the ADGM conduit be used for enforcement of English court judgments (not arbitral awards)?

Yes. ADGM Courts also recognise and enforce foreign court judgments. Once recognised, the ADGM-ADJD Protocol applies for Abu Dhabi execution. This mirrors the DIFC conduit for English judgments against Dubai assets.

What if the award debtor has assets in both Dubai and Abu Dhabi?

Run both the DIFC conduit (for Dubai assets) and the ADGM conduit (for Abu Dhabi assets) simultaneously. This is permitted and is standard practice for large enforcement matters where the debtor has pan-UAE assets.

Does ADGM recognition automatically execute against ADGM-registered company shares?

An ADGM recognition order can form the basis for an ADGM Court execution order against ADGM-registered shares. For execution against company shares (charging order or attachment), the award creditor must apply separately to the ADGM Court for the appropriate execution order.

Is there an advantage to arbitrating in ADGM vs using ADGM as a conduit?

ADGM-seated arbitrations are "domestic" ADGM awards — they do not need recognition under s 43, they are directly enforceable. Foreign award recognition under s 43 (the conduit) is a different process. If the underlying contract can specify ADGM seat, this simplifies subsequent Abu Dhabi enforcement.

How long does the full ADGM conduit process take for Abu Dhabi execution?

Uncontested: ADGM recognition 4–6 weeks + ADJD registration 2–4 weeks + Abu Dhabi execution 2–4 weeks = approximately 3–4 months total. Contested: ADGM recognition can take 6–18 months depending on grounds filed. Plan for the contested scenario when advising clients on enforcement timelines.
