How is UAE end-of-service gratuity calculated?

FDL 33/2021: basic wage only. 21 days basic per year for years 1-5; 30 days basic per year thereafter; pro-rated; capped at 2 years' basic. DIFC = DEWS defined-contribution; ADGM similar. Highest-volume MOHRE filing category.

What is the post-2022 limited-term-only regime?

Unlimited contracts abolished from 2 Feb 2022. Maximum initial term 3 years, renewable. Probation max 6 months. Notice 30-90 days. Early termination triggers Article 42/47 compensation. DIFC/ADGM still permit indefinite.

How does the MOHRE / Labour Court process work?

MOHRE filing → mediation (~14 days) → administrative decision (≤AED 50k binding subject to appeal) OR Labour Court referral (>AED 50k). 1-year limitation. No court fees for employees. Judgment 3-6 months typical.

What are the rules on non-compete clauses?

FDL 33 Art 10 + Cabinet Decision 1/2022: written, defined, limited (geography, time, scope), max 2 years, proportionate. Unenforceable if employer terminates without cause or employee terminates with cause. Damages limited to proven loss.

What does a UAE mass redundancy actually look like?

No formal collective-consultation regime. Per-employee FDL 33 ground identification, settlement template (EOSB + leave + repatriation + ex gratia), MOHRE notification, WPS final settlement. Typically a 4-12 week structured workstream.

What is the Wage Protection System?

Mandatory salary-payment infrastructure via MOHRE-registered banks. Pay within 15 days of wage period. Delays trigger work-permit suspension, fines, prosecution referrals. Common WPS issues: SME cash-flow, variable-pay disputes, EOSB not run through WPS, split-payroll non-compliance.

How are senior executive exits handled differently?

Equity vesting and forfeiture, regulatory deregistration, board removal, market-disclosure timing, public-statement coordination. Best handled through a written separation deed rather than statutory default. We act for both companies and executives.
